SafeTrace terms of use

These are the terms you agree to by using SafeTrace. They are written in the same plain way as our privacy policy, and for the same reason: terms nobody reads protect nobody. If a line below is unclear, email [email protected] and a person will answer.

Where these terms and the privacy policy describe the same thing, the privacy policy is the one that governs what happens to data.


1. Who we are

SafeTrace is built and run by Temy. "We" and "us" below mean Temy. "You" means the person who created the account.

2. Who may use SafeTrace

You must be 18 or older and you must be the parent or legal guardian of the child whose tracker you pair, or be acting with that guardian's permission.

The child is not a user of SafeTrace. They have no account, never sign in, and are never asked to agree to anything. That is a deliberate design choice, described in section 3 of the privacy policy.

3. Your account

You give us an email address that reaches you, because it is how we confirm it is really you before we act on a request about your data. Keep your password to yourself. If you think someone else has got into your account, email [email protected] and we will help you close it.

You are responsible for what is done through your account.

4. What you agree not to do

This is the section that matters most, because SafeTrace tells you where a person is.

  • Do not use SafeTrace to track anyone you are not the parent or legal guardian of, or who has not agreed to it. Tracking an adult, a partner, or somebody else's child without the right to do so is not what this app is for, and in most places it is against the law.
  • Do not pair a tracker you do not own or control.
  • Do not share your account so that somebody else can watch a child you have no arrangement with.
  • Do not try to reach another family's data, probe our servers for a way in, or interfere with the service for other people.
  • Do not resell the service, or take it apart to build a competing one.

If you do any of this we may suspend or close the account, and where a child is at risk we will cooperate with the authorities.

5. The tracker

SafeTrace works with a GPS tracker your child carries. We do not sell you that hardware, and these terms do not cover it. Whatever warranty, safety information and instructions came with the device are between you and whoever sold it.

What the app can do depends on what the tracker does: how often it reports, how long its battery lasts, and whether it has signal.

6. What SafeTrace is not

We would rather be blunt here than reassuring.

  • It is not an emergency service. If a child is missing or in danger, call the emergency number where you are. Do not wait for the app.
  • It is not a substitute for supervision. It tells you where a tracker has been. It cannot tell you a child is safe, and it cannot intervene.
  • It can fail, and sometimes will. A flat battery, no mobile signal, a tracker left in a bag at home, a phone with notifications switched off, or an outage on our side all mean you get nothing. None of these are unusual.
  • Positions are approximate, and indoors they are worse. Outdoors with a satellite fix the position is good to a few metres. Indoors it is worked out from nearby WiFi and mobile networks and can be out by tens of metres, which is enough to name the wrong floor or the building next door.
  • Some things are still being built. Push alerts are not functional in the current build, the in-app consent and withdrawal screens are still being added, and automatic clean-up of old location history is not built yet. The privacy policy says the same, in the same words.

7. Consent for a child

Before any location about a child is collected, there has to be a consent record on our servers saying a parent or legal guardian affirmed that they are the parent or legal guardian. That check runs in the database, not in a screen, so it cannot be skipped. You can withdraw at any time, which stops collection and erases the history the consent covered.

8. What it costs

Nothing today. SafeTrace is in testing and we do not charge for it. If that ever changes we will tell account holders by email before it takes effect, and you will never be charged for something you did not agree to.

9. Changes, and availability

We change the app often. We may add features, remove ones that are not working, and take the service down for maintenance. For anything that changes what these terms require of you, or what we collect, we will update the date at the top and tell account holders by email before it takes effect.

We do not promise the service is always available.

10. Ending it

You can stop at any time: delete your account in the app, or follow the deletion page. Nothing is owed either way.

We may suspend or close an account that breaks section 4, or where we are required to. If we close your account for anything other than section 4, we will tell you why and give you a chance to get your data first.

11. Our responsibility, and its limits

We will run SafeTrace with reasonable care and we will be honest with you about what it does and does not do, which is what section 6 is for.

We are not responsible for what happens because the app did not tell you something: a missed alert, a position that was wrong or late, a tracker that was out of battery or signal. This is exactly why section 6 says not to rely on it as an emergency service.

Nothing here limits our responsibility for anything the law does not let us limit, including death or personal injury caused by our negligence, or fraud.

12. Governing law

These terms are governed by the law of Ukraine, and a dispute about them is for the courts of Ukraine.

That does not take away a right you have where you live. If the consumer-protection law of your own country gives you something these terms do not, you keep it, and nothing above is meant to sign it away.
